The Department of Labor (DOL) announced a new prevailing wage determinations (PWD) for H-1B, H-1B1 (Chile/Singapore), H-1C, H-2B, E-3 (Australia), and Permanent Labor Certification Programs. Rather than obtaining the prevailing wage from the local state workforce agency, a centralized prevailing wage determination from DOL in Washington, D.C. will be used. The new procedure will become effective January 1, 2010. Beginning January 1, 2010 in order to file a PWD with the new system, Form ETA 9141 must be used. On or about January 20, 2010, DOL will implement the online prevailing wage system through iCERT, and employers will be able to file the PWD online.
